1Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "user", or "Customer"), and Dm Slide ("Company", "we", "us", or "our"), concerning your access to and use of the dmslide.com website and the Dm Slide software platform and services (collectively, the "Service").

By creating an account, connecting your Instagram account, or subscribing to our Service, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

2Eligibility and Account Requirements

To use Dm Slide, you represent and warrant that:

• You are at least 18 years old or the age of legal majority in your jurisdiction.
• You have the legal authority to bind yourself or the organization you represent to these Terms.
• You possess an authentic Instagram Professional Account (Creator or Business account) linked to a Facebook Page as mandated by Meta Platforms, Inc. architecture.
• You will maintain the security and confidentiality of your credentials and notify us immediately of any unauthorized account activity.

3Subscription Plans, Billing, and Cancellations

Dm Slide operates on a software-as-a-service (SaaS) subscription model:

• Payment Processing: All payments, billing details, and invoicing are handled securely by our payment partner, Stripe, Inc. We do not store full credit card numbers on our servers.
• Automatic Renewal: Unless cancelled prior to your billing cycle renewal date, your subscription will automatically renew at the then-applicable rate.
• Cancellation: You can cancel your subscription at any time directly through your account dashboard or Stripe billing portal. Upon cancellation, your access remains active until the end of your prepaid period.
• Refunds: Because access to the automation software is provisioned immediately, subscription fees are generally non-refundable except where required by applicable consumer law or at our sole discretion.

4Meta & Instagram Platform Compliance

When utilizing Dm Slide, you explicitly agree to comply with:

• Instagram Community Guidelines
• Meta Platform Terms & Developer Policies
• All applicable anti-spam laws, including the US CAN-SPAM Act, EU ePrivacy Directive, and GDPR.

You acknowledge that Meta imposes strict rate limits, anti-abuse algorithms, and terms of service. Dm Slide is not responsible or liable for any account actions, penalties, API revocations, or restrictions imposed upon your Instagram account by Meta resulting from your violation of Meta's policies or excessive messaging activity.

5Acceptable Use Policy

You agree not to use the Service to:

• Send unsolicited bulk messages (spam), deceptive links, pyramid schemes, or phishing attacks.
• Harass, abuse, defame, impersonate, or intimidate other users or Instagram accounts.
• Distribute copyrighted material, trademarks, or proprietary content without authorization.
• Attempt to reverse-engineer, decompile, crawl, or tamper with the Dm Slide software or infrastructure.
• Circumvent platform limits, account quotas, or security measures.

Violation of this Acceptable Use Policy constitutes grounds for immediate account suspension or termination without refund.

6Intellectual Property Rights

Our Rights: The Service, including source code, design, databases, features, algorithms, logos, and trademarks, is the exclusive property of Dm Slide and is protected by copyright, trademark, and intellectual property laws.

Your Rights: You retain full and exclusive ownership of your Instagram content, media, captions, trademarks, and user responses. You grant Dm Slide a limited, non-exclusive license solely to transmit and process your messages as required to provide the automated functionality you configure.

7Disclaimer of Warranties ("As-Is")

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DM SLIDE DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.

Because our service relies upon external APIs (Meta Platforms, Inc.), we do not warrant that Instagram API services will be uninterrupted, error-free, or perpetually available, nor are we liable for downtime resulting from Meta API outages or algorithm changes.

8Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DM SLIDE, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR ACCOUNT DISRUPTIONS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO DM SLIDE DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION ARISING.

9Modifications and Termination

We reserve the right to modify, suspend, or discontinue any aspect of the Service at our discretion. We may update these Terms periodically, with the updated date posted on this page. Your continued use of the Service following revisions constitutes acceptance of the amended Terms.

You may terminate your account at any time by disconnecting your Instagram account and cancelling your active subscription. We may suspend or terminate your account without notice if we detect abusive activity, spamming, non-payment, or breach of these Terms.
